Evicted with one hour notice. How much can I sue for in small claims?
I was kicked out of my room because I had someone staying over for the night. In the morning he left a note saying that if i dont leave in 1 hour he will tow away my car and put my things out in the street. After that he pretty much force me and my friend to leave the place using physical violence. I have the note he left as evidence. I went to a public legal assistance office and they told me i have a very strong case of unlegal eviction. The cannot tell me for how much should i sue. What do you guys think? He owes me the entire month of July that i paid already plus the security deposit. $800 total.
I already moved out from the place. It was a very scary situation. I dont have a lawyer because in small claims you represent your-self. However, I went to their legal assistance center and they told me that I had a strong case. They question comes when I am trying to figure out for HOW much to sue and for what reason? The rent that he owes me plus what?
You can not get punative damages in small claims court, only actual damage.
You can get your rent and deposit back, plus any money you paid (you have to prove this) for new housing for the 30 days you were entitled to. It can not be more then 1/30th per day of your monthly rent.
Basically you are entitled to the 800 plus one months rent for your 30 days, plus the cost of filing, do not forget to ask for that.
