Do you have to occupy a house when heading to foreclosure.?

when foreclosure is a sure thing, how long do you have to remain in the house and continue to pay only a small portion of the mortgage? When is it more sensible to move out and use the money for rent on an apartment before your credit is affected? The house is listed with a realtor at present and has had no activity. I would love to have the peace of mind and lease an apt. before my credit is damaged. How long is it necessary to stay here to show “good intent”. I can no longer make anything but small partial payments on the house.

If you are paying less than it would cost to rent a place then you may as well stay there as long as you can. In fact if the place goes into the foreclosure process (sounds like right now the bank is trying to shortsell it, which would be great if it happens but may be a longshot) you may as well stop paying anything at that time.

If you really wanted a bit more peace of mind, you could move out now and stop paying altogether but you’ll probably end up paying more in rent and will still get foreclosed on and have your credit ruined so why not just stay there.

Anyhow, the only way to avoid foreclosure (and ruined credit) is if the bank is able to short sell it (assuming thats what they are trying to do).

Also, if you could rent for less than whatever you are paying the bank now and it seems hopeless that the place will be bought I would suggest maybe walking away from it now. You’re credit will get beaten up but nothing you can do about that.

In fact, if you wanted to you could just stop paying anything altogether and save your money (living rent free) for a few months while the bank forecloses on you. Many people will object to this advise saying this is dishonest, and frankly maybe it is a bit but you sound like you are in a bad stop and really need to do what is best for you, so let those people whine all they want but still do it if you really need to.
